The “recent” changes
Over recent years, particularly in Scotland, there have been quite a lot of significant changes, developments and refinements to the law (statutory legislation and interpretation/application) affecting private landlords. These changes place a burden of responsibility (and legal liability) on the landlord.
In many cases, out-with the private rental sector, those responsibilities would fall to the property occupier – without any legal obligation or liability. Currently however, the prevailing view is that these responsibilities and liabilities should fall to private landlords within the rental sector as “business owners”.
